Facts
Jeffrey DePiano (plaintiff), a minor-league-baseball player, suffered a career-ending shoulder injury during a game. DePiano sued his team, its major-league parent, and others (baseball teams), alleging negligence for failing to provide timely and adequate medical care and for requiring him to continue playing despite knowing that further injury was likely. DePiano claimed that the baseball teams kept him in the lineup because they lacked outfielders. DePiano later amended his complaint to allege intentional injury, seeking to invoke an exception to the exclusivity of New York’s Workers’ Compensation Act. The baseball teams moved for summary judgment, arguing that DePiano presented no evidence of intentional injury.
