Nurse v. Barns
England and Wales High Court of Justice
83 Eng. Rep. 43 (1664)
- Written by Angela Patrick, JD
Facts
Barns (defendant) owned iron mills. The market rate for using the iron mills was 20 pounds per year. Barns agreed to let Nurse (plaintiff) use the iron mills for six months in exchange for 10 pounds. Relying on the agreement, Nurse obtained a stock of goods to use. However, Barns breached the agreement. Because Nurse could not use the iron mills as expected, Nurse’s stock lost its value, and Nurse suffered a loss of 500 pounds. Nurse sued Barns for breach of contract. The jury awarded Nurse 500 pounds. Barns appealed to the King’s Bench.
