Facts
Police detectives obtained a federal judge’s authorization to wiretap the phone of suspected narcotics kingpin William Muhammad. In applying for this authorization, the police fully and completely recounted the difficulty they had experienced in using conventional investigative techniques to collect evidence of the Muhammad gang’s activities and membership. This difficulty was compounded by the gang’s reputation for violence, which intimidated many potential witnesses and deterred them from stepping forward with evidence. Muhammad’s wiretapped conversations eventually revealed that David Marin (defendant) was one of Muhammad’s coconspirators. Facing prosecution in district court, Marin moved to suppress the wiretap evidence against him.
