Facts
Edward Von Hohn, II (defendant) practiced law as a partner at a large law firm during his marriage to Susan Von Hohn (plaintiff). Although Edward’s partnership agreement specified the compensation owed to a partner if the partner died, withdrew, retired, or was expelled as a partner from the law firm, the partnership agreement did not permit a withdrawing partner to be compensated for the firm’s goodwill. The partnership agreement did not address a partner’s valuation of his or her partnership interest upon a divorce. Susan filed for divorce and asked the court to determine the community-property estate. The trial court instructed the jury to include the goodwill of the law firm, if any, to value the community interest in Edward’s law practice. Edward appealed, arguing that his partnership agreement did not allow him to realize the value of the firm’s goodwill and that the community estate was not entitled to a greater share of the partnership interest than Edward was entitled to.
