Fisher v. Carrousel Motor Hotel, Inc.

Fisher was standing in a buffet line when an employee of the hotel snatched a plate from his hands shouted that a Negro could not be served in the club. No physical contact to Fisher’s person was made and there was no apprehension of physical injury, but the man was highly embarrassed and hurt by the hotel employee’s conduct.

Garratt v. Dailey

Brian Dailey, age 5 year 9 months, was visiting plaintiff's adult sister, Naomi Garratt, at plaintiff's home. Plaintiff alleged that she came out into the backyard to talk with her sister and that, as she started to sit down in a wood and canvas lawn chair, Brian deliberately pulled it out from under her, causing her to fall to the ground and fracture her hip.
