The Washington Redskins football team (PFI) (plaintiff) used and associated itself with Native American imagery. PFI initially obtained a trademark registration using such imagery in 1967. Blackhorse, a group of Native Americans, filed a petition with the United States Patent and Trademark Office to cancel PFI’s marks on the ground that they were disparaging to Native Americans. The Trademark Trial and Appeal Board granted the petition, finding that the marks were disparaging and that they should be cancelled. PFI filed an appeal with the United States District Court for the Eastern District of Virginia. Blackhorse filed a motion for summary judgment.
