Champlin Petroleum Company (CPC) (defendant) refined hydrocarbons, but some of the hydrocarbons leaked back into ground. When CPC discovered that its hydrocarbons were leaking, the company took immediate steps to stop the leak and recover those hydrocarbons that had escaped. Eventually, all of the leaks were repaired. Champlin Exploration, Inc. (CEI) (plaintiff) had taken possession of some of CPC’s escaped refined hydrocarbons. CEI brought suit seeking a declaratory judgment that it owned the escaped refined hydrocarbons that it had recaptured from the ground. The trial court ruled in favor of CPC, declining to issue the requested declaratory judgment. CEI appealed.
