Facts
The government (plaintiff) was conducting a federal grand-jury investigation and sought a court order authorizing the installation and use of a pen register and a trap-and-trace device on an email account. The application and proposed order identified the information the pen register and trap-and-trace device were intended to collect and omitted content from the request. The magistrate judge ordered that the government submit additional briefing on whether 18 U.S.C. § 3122, the statute permitting the government to apply for the installation and use of pen registers and trap-and-trace devices, authorized the use of the devices on email accounts. The government requested that the court vacate the magistrate judge’s order and grant the government’s application.
