Luria Brothers & Company (Luria) (plaintiff) sued Pielet Brothers Scrap Iron (Pielet) (defendant) for breach of a contract to deliver scrap steel. At trial, the judge excluded evidence that Pielet told Luria the contract was conditional on Pielet’s ability to obtain the scrap metal from Pielet’s supplier. Pielet appealed, claiming that the trial court’s exclusion of this evidence was erroneous.
