Mosby-Meachem v. Memphis Light, Gas & Water Division

United States Court of Appeals for the Sixth Circuit
883 F.3d 595 (2018)

Facts

Andrea Mosby-Meachem (plaintiff) worked as an attorney for Memphis Light, Gas & Water Division (Memphis) (defendant). Mosby-Meachem’s listed essential job functions included trying cases in court and taking depositions, but Mosby-Meachem had never done either of these things in her eight years at Memphis. Mosby-Meachem was confined to bedrest during her pregnancy and requested the ability to work from home during this 10-week period. Memphis denied the accommodation. Mosby-Meachem sued Memphis for disability discrimination. Mosby-Meachem presented testimony of other Memphis employees that Mosby-Meachem could fully perform her job remotely for 10 weeks. A jury found in favor of Mosby-Meachem, determining that Mosby-Meachem could perform the essential duties of her job remotely. The district court denied Memphis’s motion for judgment as a matter of law. Memphis appealed.
