Facts

In response to a consent decree entered into between the California chapter of the National Organization of Women (NOW) and the Board of Trustees of California State Universities (Board) (defendant), the California State University at Bakersfield (CUSB) decided to reduce all its male team rosters rather than eliminate any of the programs. Even though the CUSB men’s wrestling team was downsized in the number of athletic positions, it continued to win conference titles and championships. Stephen Neal (plaintiff), an NCAA champion on the CUSB wrestling team, and other members of the team, brought suit against the Board claiming that CUSB’s gender-based reduction of athletic positions violated Title IX. The district court granted Neal’s motion for a preliminary injunction and the Board appealed.
