New York State Rifle & Pistol Association, Inc. v. City of New York
United States Supreme Court
140 S. Ct. 1525 (2020)
The New York State Rifle & Pistol Association, Inc., and other individuals (collectively, the gun owners) (plaintiffs) filed an action in federal district court challenging a law passed by the city of New York (defendant) that restricted the transport of firearms outside of one’s home. The gun owners argued that the law’s prohibition against transporting a firearm to an out-of-city residence or shooting range violated the Second Amendment, and they moved for relief, which the district court denied. The gun owners appealed, and after the court of appeals affirmed, the gun owners requested, and the United States Supreme Court granted, a writ of certiorari. While the appeal before the Supreme Court was pending, the New York City law was amended so that guns could be taken out of the city to second residences or shooting ranges. The gun owners then argued that the new law might violate the Second Amendment by preventing people who were transporting firearms from making routine stops, such as for gasoline or food. The city asserted that the new law permitted routine stops.
