North American Soccer League v. National Labor Relations Board (NLRB)

The North American Soccer League Players Association (NASLPA) (plaintiff), comprised of 17 U.S. league clubs and two Canadian clubs, petitioned the National Labor Relations Board (NLRB) (defendant) for certification of a single, league-wide bargaining unit. The NLRB granted the NASLPA’s petition as to the U.S. clubs and concluded that the North American Soccer League (NASL) (plaintiff) and its individual clubs were “joint employers” of the players because both exercised a significant degree of control over their respective personnel policies. The NLRB did not exercise jurisdiction over the Canadian clubs. The NASL then appealed the NLRB’s decision.
