Facts
France (defendant) was performing atmospheric nuclear tests in the South Pacific. Australia and New Zealand (plaintiffs) brought suit in the International Court of Justice (ICJ) demanding it order France to cease performing these tests. While the case was pending, France announced it was ceasing performance of tests and that it did not plan to perform any additional tests.
