Facts

Seattle Box Co. (Seattle Box) (defendant) held an original patent for a method for bundling oil pipes for transport. The original patent claimed that the pipe would be stacked and separated by a spacer block having a height greater than the diameter of the pipe. The same year the original patent issued, Seattle Box applied for a reissue patent broadening the claims to include a spacer block having a height substantially equal to or greater than a tier of pipe length. On July 2, 1980, Seattle Box sued Industrial Crating & Packing, Inc. (Industrial) (plaintiff) for infringement of its original patent. The reissue patent issued on August 19, 1980, and Seattle Box amended its complaint in October to allege infringement of the reissued patent. The district court found Industrial liable for infringement of both patents and awarded damages to Seattle Box. Industrial appealed.
