Facts

Shapiro & Son Bedspread Corp. (Shapiro) (plaintiff) and Royal Mills Associates (Royal) (defendant) were competitors in the bedspread industry. In 1978 Shapiro created and marketed a faux-lace line. A copyright notice for the design was included in a flyer or insert enclosed in the bedspread’s packaging. In 1983 Shapiro registered the copyright with the United States Copyright Office. Around this point, Shapiro began affixing a copyright notice to the product on a sewn-in label, but only on bedspreads that had yet to be shipped. Toward the end of 1982, Royal began selling bedspreads with a similar design. Shapiro alleged infringement and sought a preliminary injunction in the United States District Court for the Southern District of New York to prevent additional sale of the bedspreads.
