Facts
A driver and a passenger died in a car accident. Robin Prinz, the executor of the decedent passenger’s estate (plaintiff), brought suit against the decedent driver’s estate, including an insurance claim against State Farm Fire & Casualty Company (defendant). State Farm sought to introduce testimony of the decedent’s driver’s family members and other evidence tending to show where the decedent driver lived when he died. The circuit court excluded the evidence based on West Virginia’s Dead Man’s Statute. State Farm appealed.
