Facts
Adrienne Tomkins (plaintiff) was an office worker at Public Service Electric & Gas Company (Public Service) (defendant). Tomkins complained to Public Service after her supervisor asked her to go to lunch and made sexual advances towards her. Tomkins’s supervisor gave her an ultimatum to have a sexual affair with him or lose her job. After Tomkins refused, her supervisor grabbed her arm and told her she could not leave. Tomkins sought a transfer and accepted a less desirable position. Fifteen months later, Public Service fired Tomkins. Tomkins sued Public Service. Tomkins alleged that her supervisor’s sexual advances and threats of firing plus Public Service’s retaliatory termination violated Title VII of the Civil Rights Act of 1964 (Title VII). Public Service moved to dismiss the complaint for no cause of action.
