Facts

Butler Watts (plaintiff), a disgruntled auto-repair customer, sued Robert B. Baker Jr. and his employer (defendants) for damages for injuries that Watts received when Watts and Baker got into an altercation over a repair to Watts’s car. Baker struck Watts twice in the face without Baker receiving a blow, and Watts fell to the floor and lost consciousness for several minutes. Conflicting testimony was presented regarding whether Watts cursed or threatened Baker and whether Watts drew back his fist to hit Baker before Baker hit Watts. The jury returned a verdict for Watts, and Baker appealed.
