Public support for legalized cannabis is at an all-time high, and at least 33 states have legalized it in some fashion. In light of the booming cannabis industry and the significant regulatory challenges that cannabis-related businesses face, the need for legal advice is industry-wide. However, giving cannabis-related legal advice can raise some hazy ethical issues for attorneys, due in part to the continued illegality of cannabis at the federal level. In this presentation, we will examine both the ABA Model Rules of Professional Conduct and a selection of state rules and opinions as we work through the ethical implications for lawyers who don’t stay off the grass.

Attorneys in firms of all sizes – from solo practitioners to lawyers are multinational Big Law firms - face a number of ethical issues relating to cybersecurity, and preserving the confidentiality and security of their clients’ data. Contrary to what some lawyers may believe, law firms are often a valuable target for hackers because they can hold vast collections of sensitive and highly valuable client-related data. These cybersecurity threats come from individual hackers, international cybercriminals, and even a firm’s own attorneys and other employees. This program provides a basic primer on attorneys’ ethical obligations to understand and address the cybersecurity risks they face, and provides practical advice for attorneys in addressing issues that arise will undoubtedly arise in their legal practice.

This course surveys federal law as it relates to people with disabilities—specifically, you will learn about the protections provided to disabled persons under the Americans with Disabilities Act (ADA). This CLE course is the first of a two-part series. The primary focus of Part I is to provide an overview of the ADA’s non-discrimination provisions as they apply to employers, government entities, and public accommodations. Then, the focus of Part I will be on employment discrimination under Title I of the ADA. The course will provide attorneys with a working knowledge of Title I to better represent clients who face employment discrimination on the basis of disability.

Have you ever thought about what is stored in your mobile phone, smartwatch, or laptop when you travel, and who can access that information? This course will address the current state of the law governing searches of international travelers’ electronic devices at the U.S. border. The course will then discuss the changing legal landscape in light of technological advancements in the amount of digital data that people carry with them when they travel.

The powerful public interest in preventing the spread of contagious diseases has led to a longstanding history of vaccination mandates being imposed as a prerequisite to access to various rights, such as education and employment. At some points in history, nonvaccination has even been punished with fines. Balancing out this imposition, systems have been established to compensate the small proportion of individuals who claim to have been harmed by an adverse reaction to a vaccination. This course will examine the legal basis and structure of vaccination mandates, including public mandates imposed by state and federal government entities and private mandates imposed by employers. The course will cover the common exemptions from vaccination and accommodations required by employers under federal law. The course will then turn to the function and operations of the National Vaccine Injury Compensation Program, and to other routes of injury compensation available for vaccines not covered under that program.

On July 27, 2006 President George W. Bush enacted the Adam Walsh Child Protection and Safety Act. This law was meant to protect children from sexual exploitation in violent crimes, prevent child abuse and child pornography, and to promote Internet safety. However, the act also amended INA Section 204 and effectively prohibited US citizens and lawful permanent resident aliens who have been convicted of any “specific crime against a minor” from filing any family-based immigrant petition on behalf of any beneficiary. In this program, forensic expert Mark Silver presents an overview of the Adam Walsh Act as it pertains to immigration defense lawyers who assist clients with family-based immigration petitions. Mr. Silver will also address how clinical evaluations help advocate for the family members.

Transactional attorneys need to understand, appreciate, and actively assess their risks to prevent ethical violations and malpractice suits. In this presentation, we will address a broad range of ethical issues relevant to transactional practice. Particular emphasis will be on ethical perils in the M&A context, including mistakes, conflicts of interest, attorney-client privilege, candor in negotiations, and cybersecurity and technological competence. Each peril will be paired with a helpful list of pointers to help the M&A attorney prevent it.

In this course you will learn the basics of the world’s leading privacy law – the General Data Protection Regulation (GDPR). We will address key provisions of the GDPR including who it applies to and the obligations it imposes. We will address the fundamental privacy rights of individuals including the right to privacy, the right to transfer personal data, the right to be forgotten and more.

Cyber-based claims are an exponentially growing threat to attorneys. Cyber risks touch on every area of practice and overlap with the two greatest sources of professional risk to attorneys – ethical obligations and legal duties to clients. This course explores the basics of legal malpractice claims along with corresponding ethical considerations in the context of the cyber threat while providing practical advice for anticipating, mitigating and surviving cyber risks and related claims. Cyber-based causes of action, common defenses and jurisdictional considerations will be reviewed as well as risk management techniques and best practices, including an overview of how to develop a cyber risk management team and plan.

The DOL’s 2022 budget and the Biden Administration’s proposed budget for the Occupational Safety and Health Administration in 2023 seeks funding to hire significantly more OSHA inspectors.  In addition, Doug Parker was sworn in as Assistant Secretary of Labor for OSHA on November 3, 2021, and based on his prior role as chief of California’s Division of Occupational Safety and Health, employers should expect increased rulemaking and more aggressive enforcement activities in the coming years. You will hear from a former OSHA trial attorney as he discusses OSHA hot topics and future agenda items.  These issues include an update on OSHA’s COVID-19 guidance for general industry and the status of OSHA’s health care permanent COVID rule.  Other areas will include discussion of OSHA’s heat stress enforcement and rulemaking; reviewing highly targeted inspection industries; identifying the most common OSHA citations in 2021; workplace violence; proposed changes to the electronic recordkeeping rule; review of recent OSHA standard interpretation letters on recording injuries; overview of the new hazard communication final rule and other expected rulemaking proposals.

Electronic communications and e-signatures have amplified the speed and number of contracts entered into everyday. The rapid changes in technology have also imposed rapid changes on a legal system that is traditionally slow to adapt - the Uniform Electronic Transaction Act has been implemented in almost every state for close to 20 years, yet many attorneys still insist on printing, signing and scanning signature pages. In this CLE course, attorney and eDiscovery specialist Aaron Cronan will cover some of the most important implications for contract formation and enforcement in the digital age. He will focus on a legislation overview, electronic signatures, Statute of Frauds, UCC, assent of the parties, Browser/Clickwrap, and best practices. This session will include examples and case law from across the county to identity trends and traps.

This program will consider how to manage stress and how to recognize signs of burnout in ourselves and others on our legal team. We will also examine the differences between burnout and depression, look at some strategies for using stress for good, e.g., to regain focus to advise clients and anticipate future challenges, and some maladaptive strategies for coping with stress and how that impacts upon our duties of competence, diligence and communication with clients. Welcome to Unfair, Deceptive, or Abusive Acts or Practices (UDAAP). UDAAP is arguably the most important regulation in the mortgage industry. UDAAP impacts every other lending regulation (marketing, fair lending, licensing & communication) and it impacts every part of the lending cycle (advertising thru servicing closed loans.) What makes this regulation so difficult for mortgage lenders is that it is very subjective (“reasonable consumer” point of view) and is very difficult to defend against. Chapter 7 and 13 are the primary chapters of bankruptcy relief available to consumers who find themselves in over their heads with debt. This course will explain the basics of Chapter 7 and Chapter 13 cases for consumer debtors. The first half will explain the basics of both chapters, the elements of each one and the players and their roles in each type of case. The second half of the course will walk through the handling of a case from inception to discharge.

The purpose of this class is to educate legal professionals on how cell phone forensic evidence is extracted from cell phones, tablets, and other mobile devices. Explanations will be given on what is in accordance with forensic best practices, and how this evidence is properly preserved. In addition, attendees will learn about the fragile nature of digital evidence, and the extent to which this information can be changed if not handled correctly. Attendees will learn the types of evidence that can be recovered from cell phones, including location-based information, messaging application data, voicemails, multimedia such as photos and videos, meta-data, and more. The different forensic artifacts will be explained in detail. Given the rising instances of fake text messages and call spoofing, a section of this class will explain how this is commonly done, even by people with little technical knowledge, and how an investigation is performed todetermine the authenticity of such evidence. Upon completion of this class, attendees will have a working knowledge of how cell phone forensic data collections are performed, the types of forensic artifacts that are recoverable, how data is authenticated, and how such evidence can be used for their purposes when working a case.
