We will use real cases and the ABA Model Rules of Professional Conduct to explore where the line is with respect to lawyer advertising, trial publicity, statements to the media, political speech in the courtroom, criticism of judges, and more.

Electronic communications and e-signatures have amplified the speed and number of contracts entered into everyday. The rapid changes in technology have also imposed rapid changes on a legal system that is traditionally slow to adapt - the Uniform Electronic Transaction Act has been implemented in almost every state for close to 20 years, yet many attorneys still insist on printing, signing and scanning signature pages. In this IP analysis for transactional lawyers in due diligence or representing small/medium businesses, we look at the major areas of IP law to understand what the IP assets are exactly, how to make sure they are valuable assets and scheduled properly, how to assess if there is potential value that is being missed, and registration regimes for different IP classes to guarantee the most protection. This course introduces American lawyers to trade secret protections in the European Union. Trade secrets—broadly defined under E.U. law as information that derives commercial value from its secrecy, and for which reasonable protections have been taken by the holder to preserve that secrecy—have, since 2018, benefited from a uniform set of protections across E.U. Member States. This is thanks to a European Directive, “Directive (EU) 2016/943 on the protection of undisclosed know-how and business information (trade secrets) against their unlawful acquisition, use and disclosure.” The present course will discuss the Directive’s origins, it scope and purpose, and the primary exceptions to trade secret protections in the E.U.

The National Firearms Act of 1934 (the NFA) was one of the first pieces of federal gun legislation passed in this country and yet remains a source of confusion among attorneys and non-attorneys alike. This presentation will cover what types of firearms are regulated by the NFA, what firearms are outside its scope, the registration and transfer processes, and the penalties for violating the NFA. We will also discuss proposed legislation and regulations that impact the NFA, as well as challenges to the NFA that can be expected in light of the NYSRPA v. Bruen U.S. Supreme Court decision in June 2022. This course will be of interest to attorneys who practice firearms law, those in the firearms industry who work with firearms, and all those who simply want to gain a greater understanding of firearms regulation today.

On May 1, 2020, the U.S. Department of Health and Human Services (HHS) implemented a paradigm shift in the manner in which patient electronic health information (EHI) is accessed, used, and disclosed through its publication of the Information Blocking Rule. Shifting from a landscape dominated by the Health Insurance Portability and Accountability Act (HIPAA), which imposed a permissible data disclosure framework under its Privacy Rule, the newly passed Information Blocking Rule imposes mandatory disclosure requirements on healthcare actors. Implementing the Information Blocking Rule’s requirements has proven challenging to many health care actors, who still struggle to achieve compliance amidst the shifting regulatory standards. This CLE provides an overview of the Information Blocking Rule and its exceptions, highlights common compliance challenges that have arisen in the information blocking context, and proposes risk mitigation strategies to help health care actors achieve compliance.

The Course will focus on recent CFPB announcements and directives affecting real estate specifically regarding the Fair Credit Reporting Act, Prosecution of discriminatory lending practices, Clarification of Rules and Regulations, and an Explanation of the Rule pertaining to the transition away from the LIBOR index for determining rates on adjustable loans.

Truck accidents are different than car accidents. There are added regulations, additional evidentiary issues, and the regular need for experts. Because of this, it is difficult to tackle a truck accident case without significant experience. This course will provide an overview of the basic steps in how to litigate a truck accident case. In this overview of the provisions of the FAA Reauthorization Act of 2018 governing the privacy practices of commercial drone operators, we cover key provisions governing operators’ privacy policies and compliance with the emerging patchwork of state and local information privacy and security laws. We also address emerging issues in federal preemption law related to the applicability of state and local information privacy and security laws to the aviation sector.
