Welcome to Unfair, Deceptive, or Abusive Acts or Practices (UDAAP). UDAAP is arguably the most important regulation in the mortgage industry. UDAAP impacts every other lending regulation (marketing, fair lending, licensing & communication) and it impacts every part of the lending cycle (advertising thru servicing closed loans.) What makes this regulation so difficult for mortgage lenders is that it is very subjective (“reasonable consumer” point of view) and is very difficult to defend against. So this is why it is critical for lending/real estate lawyers to understand how this regulation operates in practice.

Until very recently, the NCAA prohibited student-athletes receiving compensation due to their “amateur” status. In this course, we examine landmark cases review the NCAA actions for potential antitrust law violations. We also look ahead to the future of college athletics in the new name, image, and likeness (“NIL”) era.

No longer merely a sci-fi concept, the Metaverse has become the latest iteration of the Internet for businesses, employers, and social gatherings. With a variety of tech companies creating Metaverse platforms, companies hosting virtual reality workspaces, factories setting up shop with digital twins, and groups socializing at simulated concerts, lawyers must take the reins in guiding how this new world is regulated. The body of Internet Law is constantly evolving, especially due to the fast-moving nature of technology. The Metaverse is gaining in popularity, and before universal adoption, we must consider the legal concepts necessary for this immersive, virtual world - and the ethical dilemmas it already faces.

The pretrial playing field has changed markedly over the last three decades, moving the battleground from the jury to the gauntlets that leave a judge with discretion to eliminate or trim a case before it even sees a jury. Standards governing motions to dismiss, summary judgment, experts, the breadth of discovery, and even class certification are the battlegrounds that often determine the fate of a case. Against this backdrop, technology - including the internet and the ability to create real-time recordings of events - has markedly changed the availability and quantity of evidence. Selecting the most compelling evidence - or deselecting evidence is a new challenge in addition to the age-old skill of constructing a narrative that glues the theories in place. Precision in the pretrial process and an appreciation for the evidentiary rules and their interface with the procedural rules are essential. From complaint preparation through discovery and motions practice, this 60-minute session will provide listeners with a crash course overview of what is needed in this new era of front-loaded litigation.

Rent control is a critical but little understood part of New Jersey residential landlord-tenant law. This introductory course to rent control discusses the constitutional underpinnings of a municipal rent control ordinance. Once the constitutional framework is established, the course describes the practical application of a rent control ordinance to landlords and tenants—using the City of Jersey City Rent Control Ordinance as a model. Practitioners will learn the criteria used for evaluating the constitutional compliance of an ordinance and how its provisions affect a landlord’s return. Practitioners will also learn the basic administrative requirements of a rent control ordinance and the high price paid for non-compliance.

Changing a professional sports team name may seem like it requires a simple press release announcement that introduces a new mascot, logo, or merchandise. In this course, we analyze some of the major legal obstacles to changing and owning rights to a new team name—specifically in Cleveland—where a local roller derby team claimed it previously owned the same name that a baseball team tried to acquire. We also discuss integral factors that affect legal disputes surrounding trademarks.

For more than 30 years, the win-loss record for tribal interests at the United State Supreme Court was dismal. Since 2018 however, tribal interests have been on a remarkable winning streak in the United States Supreme Court. But what is the continuing outlook for tribal interests at the Supreme Court? This program will analyze past cases decided by the Supreme Court and consider what they might portend for the future as well as providing a thorough analysis of the Haaland v. Bracken decision. The program will benefit tribal attorneys, practitioners of federal Indian law, and other attorneys who wish to learn more about federal Indian law.

In this course, Camden Webb, who is a partner at Williams Mullen, will discuss theories of potential liability for the means by which firearms industry members market their products and will provide useful strategies for reducing liability risks. The course will provide an overview of the statutes and case law that regulate this issue, including the Protection of Lawful Commerce in Arms Act, case law interpreting the statute, developments regarding the theories of potential liability for marketing of firearms, and new state statutes that could increase risk to firearms industry members. Attendees will learn about the applicable law and the theories of liability, the best practices for monitoring and policing marketing strategies, and the steps that can be taken to reduce the risk of potential liabilities.

This CLE will provide an in-depth look at the final beneficial ownership reporting rule under the Corporate Transparency Act. It will cover issues such as who needs to report beneficial ownership information, who is a beneficial owner, what information needs to be reported, and in what form the information should be provided. Michael Rosensaft will also discuss FinCEN’s response to commenters' concerns. It will cover the possible changes to the rule, that FinCEN accepted or rejected, and the possibility of future rulemaking.

This program will briefly discuss the purpose of the IDEA and the standard for individualized education programs (IEPs), and will discuss more in-depth the sections of IEPs and what they should entail. This program will also cover evaluations, and what districts are required to do, as well as parent’s rights. The program will be New York based, but New York’s regulations strongly mirror federal law, and differences will be noted. It will also cover updates in special education law, including the COVID pandemic and its impact. This program will benefit new attorneys to the special education field, and attorneys who are seeking to better understand what an IEP is, how it is created, and what it is based on in order to be appropriate.

In this one hour course, attorney Charles “Chuck” Dalziel, will take a deep dive into the current statutes and recent decisions that affect access to various types of court records. We will discuss how the U.S. Constitution and various federal statutes extend to the right to access court records depending on they type of case you are dealing with, including the limitations on using and obtaining juvenile court records. This course will also provide an overview on how to obtain court records and review relevant caselaw in this area.

Notwithstanding its illegality under federal law, cannabis is now legal for medical and/or adult recreational use in a majority of states. The tension between state and federal law (and the newness of a quasi-legal cannabis industry), however, complicates the legal representation of cannabis industry clients and raises potential ethical pitfalls. The representation of cannabis clients in Intellectual Property (IP) matters is no exception and implicates unique strategic concerns.

In this discussion of the Federal Water Pollution Control Act (the “Clean Water Act”), 33 U.S.C. § 1251, et seq., we will address the Clean Water Act and the Supreme Court’s “functional equivalent” standard established in the Supreme Court’s County of Maui v. Hawaii Wildlife decision. We will cover the history of the Clean Water Act with respect to point sources, the evolution of how point sources have been defined since the Clean Water Act was established, and the newly adopted “functional equivalent” standard. We will focus our discussion on the County of Maui decision and address what the standard means for the environmental law practitioner.

In this seminar, forensic expert Mark Silver provides the immigration lawyer with a detailed analysis of criteria considered by clinical experts when undertaking a psychosocial evaluation in extreme hardship cases for waivers and cancellation of removal cases. Here, Mr. Silver integrates important legal considerations with the psychosocial criteria offering new and different insights to better advocate for the clients and their family members. He also reviews the different challenges that have an impact on extreme hardship considerations. Additionally, he addresses how to best present these issues to help your client.

In January 2022, the Supreme Court issued two highly-anticipated opinions about the Occupational Safety and Health Administration’s Emergency Temporary Standard on vaccination and testing (“OSHA ETS”) and the CMS Medicare and Medicaid Programs Omnibus COVID-19 Health Care Staff Vaccination Interim Final Rule (“CMS Vaccine Mandate”), related to the COVID-19 vaccination. In this program, we will speak with vaccine law expert Brian Dean Abramson to review the relevant precedent and procedural history surrounding these two cases. We will use these decisions as a starting point for a broader discussion about the legal history and future of vaccination mandates in the United States.

During the COVID-19 pandemic, many lawyers began working remotely from home every day. How do the ethics rules apply to long-term remote or “hybrid” practice? In this course, we will explore some of the rules of professional responsibility implicated by long-term remote and hybrid practice—including the rules of confidentiality, communication, supervision, and competence—and offer practical tips for ethical compliance. We will end with a discussion of the rules on unauthorized practice of law and the ethics opinions offering guidance to lawyers who may be living and working remotely from a state in which they are not admitted to practice.

In this course, we will analyze the historical context of civil RICO claims and explore how relevant case law affects a RICO case plaintiff, including the particularity required of a claim (time, place, etc), details of the mental state, and pattern of activity.

Although the social significance of the female body has changed over time, the undercurrents of power, control, and stigmatization have remained constant. Following the digital health revolution, new technologies have emerged with the potential to quantify and further ostracize women under the guise of liberation. The female health technology (femtech) market promises to increase scientific and personal understanding of women’s bodies and destigmatize female sexuality. However, portions of the femtech industry have been built on inaccurate and stereotypical assumptions of women’s health and preferences. This presentation explores the legal and ethical challenges of the femtech sector and seeks to foster a dialogue on the legal and ethical pitfalls of monetizing women’s health data and equating women’s health with reproductive health and sexuality. The topics addressed in this presentation include (1) data inaccuracies and algorithmic bias; (2) faulty products and skewed research data; (3) design flaws and the “othering” of specific sub-categories of the female population; and (4) monetization of femtech data.
