An Overview of Class Action Law
Class action law pertains to legal actions in which a group of individuals collectively brings a lawsuit against a defendant or defendants. These individuals, known as class members, typically share common legal issues or injuries arising from the actions of the defendant(s).
Class actions serve several purposes, including efficiency in adjudicating claims involving numerous parties, promoting access to justice for individuals with small claims, and deterring unlawful conduct by defendants.
The class action process involves several stages, including class certification, notice to class members, settlement negotiations, and ultimately, trial or settlement approval by the court. Class certification is a critical step in the process, requiring the court to determine whether the proposed class satisfies the requirements of numerosity, commonality, typicality, and adequacy of representation.
Class action litigation can involve a wide range of legal issues, including consumer protection, securities fraud, employment discrimination, product liability, and antitrust violations, among others. Introduction to Class Action Litigation
This course is a primer to class litigation, in essentially three parts: Part 1 is class action legal theory, Part 2 is the public policy debate, and Part 3 is class litigation in practice. Part 1 will address the creation of Federal Rule of Civil Procedure 23, as well as key legal developments in class action law, including Wal-Mart v. Dukes, Campbell-Ewald v. Gomez, Amchem v. Windsor, and others, up through the present day. Part 2 will address the major arguments both for and against class actions as public policy. We will then take a deep dive into the First Amendment “Commercial Speech” Doctrine discussing its outright exceptions and developing regulations, noting the difference between viewpoint and content based restrictions. Lastly, we will analyze a trio of recent cases that have raised the possibility that Central Hudson is becoming “Zombie precedent.”
Class Action and Auto Insurance Litigation: A Primer on Litigating Total Loss Vehicles on a Classwide Basis
Since 2015, there has been a significant increase in class actions addressing total loss auto insurance, starting in Florida and now expanding into numerous other states. It is now perhaps the most litigated issue in the class action insurance area of law. This course addresses the three major theories under which these cases are brought, along with the major issues, both as to the merits and class certification, particularly from the plaintiff's perspective.
Basic and Beyond: Litigation and Expert Opinions in Securities Class Actions
Since the late 1980’s with the US Supreme Court’s landmark decision in Basic Inc. v. Levinson, in securities class actions, plaintiffs have been able to rely on the “fraud-on-the market” presumption of reliance at class certification. In recent years, the validity of that presumption and its evidentiary burdens at the class certification stage have been repeatedly questioned, leading to a “battle of the experts” to determine whether a class should be certified. This course examines the evolution of the fraud-on-the-market presumption and its uses at class certification and then delves into expert’s role in securities class actions at the class certification stage.
