Definition

A real property theory that grants title to real property to a person who uses a plot of land and meets certain elements for the required statutory period. To establish adverse possession under claim of right, the possessor’s use of the land must be open, exclusive, hostile, and adverse, and the possessor must have believed in good faith that she had a right to use the land.
