Definition

Test A test for determining if, for purposes of the Administrative Procedure Act, a federal agency's action is final and therefore judicially reviewable. The test is derived from Bennett v. Spear, 520 U.S. 154 (1997), and defines a final agency action as one that: (1) marks the consummation of an agency's decision-making process, and (2) determines rights or obligations from which legal consequences flow.
