Motion to Dismiss for Failure to State a Claim Upon Which Relief Can Be Granted


Should be granted where the plaintiff cannot possibly prove any facts in support of her claim that would entitle her to relief. Only the pleadings are considered and the facts are viewed in light most favorable to the plaintiff. See FRCP 12(b)(6).
