Rule 804(b)(1) of the Federal Rules of Evidence


Provides that former testimony of a witness is admissible if it offered against the same party it was originally offered against, the witness is unavailable to re-testify, and the party against whom the testimony is being offered previously had the same motive and opportunity for cross-examination.
