It has now been over 18 months since the legal profession was turned upside down with the advent of the COVID-19 pandemic. Every area of the law was hit hard. However, the law is not static and despite a pandemic, we adapt and move forward albeit slowly. Indeed, one of the areas which has been brought to the forefront (even on a national level) is landlord-tenant law. Regardless of what side of the coin you are on (landlord or tenant, commercial or residential), major issues have arisen. Thus, the question is despite a pandemic and the somewhat new way of doing things how do we, as practitioners, navigate these uncharted waters? In this course, we will examine the various issues which have presented themselves along with some suggestions for how to deal with them. Of particular interest are many of the moratoriums which have been put in place to purportedly stave off an avalanche of evictions. Presented by Kenneth W. Biedzynski, Esq., this course will canvas and discuss all of the above topics and more.

National attention has addressed the pay gap for women. Beyond that, there is an information gap, a power and understanding gap, and common perceptions of femininity that have resulted in institutional disadvantages for female attorneys, especially litigators. This program exposes nationwide statistics regarding the wage gap between female and male attorneys and pays special focus to recent academic and bar association studies addressing gender differences in the profession. The course also addresses practical ways to overcome this gender gap, including negotiation strategies and skills to foster leadership and opportunities for professional development. The goal of this program is not just to raise awareness of the issue but to also offer its participants the opportunity to solve the problem.

This program will focus on Workers Compensation, Social Security Disability Benefits, and Unemployment Benefits. After an overview of each program’s basics, we will begin with a recapturing public benefits policies from the Covid-19 Pandemic. We will review and assess the current state of these benefits programs in terms of both legal changes and operational changes. The final portion of the program will look at the political, global, and economic factors impacting these programs. We will focus on predicting the impacts on public benefits and proactive steps we can take to best prepare your clients.

This course provides insight into the new California law (AB 288) that comes into effect in January 2023 and will change how companies and brands run online charitable promotions. This new comprehensive law significantly changes the landscape of national online charitable promotions. This course will provide participants tips to recognize when and to whom this new law applies, how to comply with the requirements of the new law, including registration of promotions, contracts with charities, sending donations to charities and disclosures.

Substance use disorders and mental health challenges can affect any attorney regardless of gender, culture, ethnicity, age, or socioeconomic status. This program, taught by seasoned attorneys Laurie Besden and Tracy Kepler, instructs attorneys on how to recognize the impaired professional, provides various resources to assist in the recovery and identifies the possible disciplinary implications of impaired attorneys' conduct. Ms. Besden will share her personal journey from the darkness and depths of despair in struggling with a substance use disorder as a licensed attorney, to her path of long-term recovery, where she received a full Governor's Pardon in 2020.

Probate law is the body of law that deals with legal incapacity and the issues that come up after death. The vast majority of probate issues involve the administration of the estates of deceased people. In this course, you will learn how to effectively and efficiently guide fiduciaries through the probate administrative process.

As data breaches continue to proliferate, state legislatures across the country have strengthened their existing data privacy and protection statutes, or have created new ones, with an increased focus on consumer protection. This program will provide an overview of trends in this legislation, with an emphasis on how the states are shifting their focus towards compressive data privacy laws that put more control over how personal data is used into the hands of consumers. The program will also provide an overview of cyber best practices, and how those practices translate into statutory best practices.

A personal injury case often needs an estate lawyer - and an estate lawyer often needs a personal injury lawyer's perspective. Alex Weatherby will start with a discussion on wrongful death and related claims, as there are unique issues in the state of Georgia that can make prosecuting a wrongful death claim tricky. He'll also cover claims involving a minor, because probate courts play a significant role in these claims as well. There is, obviously, much more to litigating both wrongful death and minor injury claims than can be covered in one hour. This course serves as an overview of the types of personal injury cases that will primarily intersect with probate and estate law.

In 2022, health care enforcement remains a focus of federal law enforcement agencies. Over the last few years, the DOJ brought a record-number of prosecutions related to health care fraud and anti-kickback violations, particularly in the realms of telemedicine and laboratory testing services. Perhaps unsurprisingly, prosecutors have also targeted fraud and other criminal schemes related to the COVID-19 pandemic since 2020.
Such investigations and prosecutions can make the acceptance of funds from federal payers (e.g., Medicare, Medicaid) fraught with risk for providers and related entities. In this presentation, we’ll discuss the key issues and claims on which federal prosecutors, often aided by agents from the U.S. Department of Health and Human Services, have focused in recent investigations and prosecutions.

There are 574 federally recognized Indian Tribes in the United States, and approximately 300 reservations covering nearly 55 million acres. Under the Environmental Protection Agency’s 1984 Policy for the Administration of Environmental Programs on Indian Reservations, EPA recognizes Tribal Governments as sovereign entities with primary authority and responsibility for the reservation populace, and the appropriate non-Federal parties for making decisions and carrying out program responsibilities affecting Indian reservations, their environments, and the health and welfare of the reservation populace. This course will explain the unique role of Indian Tribes in environmental law: in resource use, protection, and regulation under federal statutes, treaties, and Tribal law both on and off the reservation

Drafting a trust can seem overwhelming. This course will help you navigate what kind of trust you will need as part of a Will or Revocable Trust and discuss key provisions that can be included. We will focus on practical drafting advice in order to ensure that attorneys have the tools necessary for success.

This course will provide an overview of issues related to the gender gap and patents as well as patent law. The course will focus on the 2019 “Progress and Potential: A Profile of women inventors on U.S. patents” published by the United States Patent and Trademark Office (USPTO) as well as the 2020 update on women inventor-patentees. The course will then look at the gender gap and patent law, both in terms of practicing before the USPTO as well as attorneys involved in patent litigation. The course will also highlight efforts being made to close the gender gap when it comes to patents and what else may be done.

This course will provide an overview of fresh water law in the United States. We will cover both the law and policy aspects within water law while analyzing the balance between public rights and private rights to use water, including private ground water rights, and private water harvesting rights. While also covering water usage and its impact. Water is the heart of agriculture, commerce, transportation’s, recreation, and survival.

Chapter 7 and 13 are the primary chapters of bankruptcy relief available to consumers who find themselves in over their heads with debt. This course will explain the basics of Chapter 7 and Chapter 13 cases for consumer debtors. The first half will explain the basics of both chapters, the elements of each one and the players and their roles in each type of case. The second half of the course will walk through the handling of a case from inception to discharge.

This course will provide an overview of fashion law and how it intersects with intellectual property. The course will touch on more commonly known areas of fashion including apparel, shoes, and accessories. This course also will address how fashion is going beyond just the clothes or the accessories themselves and now reaching more into technology including supply chain optimization, virtual fitting rooms, and wardrobe recommendations using artificial intelligence (AI).

This lecture will present the interdisciplinary perspective relating to custody matters when presented with cultural and religious issues and discrepancies between parents. It will review case law and psychological protocols that are used to understand what factors a court will consider and what weight it will attribute in the handling of the matter.

This CLE program will cover the principal legal ethics rules implicated by lawyers’ social media use. In particular, we will cover the ethics rules governing confidentiality, trial publicity, and attorney advertising and solicitation— Model Rules 1.6, 3.6, 7.1 and 7.3— and how those rules interact with lawyers’ social media use. The second half of the presentation will detail the investigative uses of social media, including how Model Rules 4.2, 3.5, and 8.4 govern contact with represented persons, researching jurors, and impeaching witnesses.

This course provides an overview of the essentials of Intellectual Property (IP) that all attorneys and entrepreneurs should know, including the types of IP, procurement basics and strategies, enforcement, defense, and how to mitigate IP litigation risk. The course further provides an overarching explanation of the full patent lifecycle as to enable participants to assess whether, why, how, and when obtaining patent protections might be worthwhile for a particular business endeavor.

Young and old attorneys can always learn something about Trademark Law. In this introduction to Trademarks, attorneys learn the basics of Trademark Law from prosecution of a Trademark to obtain one through litigation when a Trademark is infringed. The presentation is broken down into three sections. First, the results of an interview with a Trademark Examiner from the United States Patent and Trademark Office about her prosecution pet peeves is addressed. Second, the basics of Trademarks is presented. Third, a sample case on Trademark infringement is thoroughly analyzed and discussed.

While not the most glamorous part of litigation, document requests are a key method for obtaining winning evidence. This CLE covers writing and responding to document requests during the discovery phase of a lawsuit. Participants will learn practical tips they can implement in their own practices to draft effective document requests and think strategically when objecting and responding to document requests served on their clients. Participants will also gain insight into negotiating the scope of document requests and preparing for motion practice along the way, in case those negotiations break down.
