Dave’s practice is focused primarily on construction-related and premises liability litigation. He regularly defends property owners, developers, managing agents, general contractors, construction managers, and subcontractors of all kinds in connection with claims brought pursuant to the New York State Labor Law. He also handles insurance coverage disputes, breach of contract cases, property damage claims, and other liability matters. He defends lawsuits at both the trial and appellate levels.

In addition to routinely achieving favorable results for his clients through mediation and other ADR proceedings, Dave has successfully argued dozens of appeals over the course of his career. Representative cases include Pita v. Roosevelt Union Free School Dist., 156 A.D. 3d 833 (2d Dept. 2017), and Palomeque v. Capital Improvement Services, LLC, 145 A.D. 3d 912 (2d Dept. 2016). Dave frequently lectures to insurance, construction, and property management groups as to recent developments in the New York State Labor Law, as well as effective risk transfer strategies in connection with construction site claims. He also co-chairs the MMP &S Training Committee and regularly presents practice seminars to other attorneys at the Firm. Dave received his J.D. from Emory University School of Law in 2001, after receiving a B.A. from Binghamton University in 1997. He is admitted to practice before the State and Federal Courts of the State of New York.
