Chevron Deference

Definition

A court’s deference to an agency’s statutory interpretation, based on the court’s finding that: (1) Congress either did not address the issue in question directly, or addressed the issue ambiguously and (2) the agency is responsible for implementing the statute, and it has interpreted the statute reasonably. This two-part test was first applied in Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc., 467 U.S. 837 (1984).
