Collateral Proceeding
Definition
A proceeding outside of the direct appeal process that attacks a final judgment. Considered a proceeding of last resort, collateral proceedings include habeas corpus petitions and attacks on the legality of the judgment or sentence. Also called collateral attacks or indirect attacks.
