Definition

A factor in determining a criminal defendant’s sentence under the Federal Sentencing Guidelines. A defendant’s criminal-history category is calculated based on the maximum sentence for the defendant’s prior crimes and whether the defendant has previously violated the terms of probation, work release, or similar. There are six criminal-history categories, with category six being the most severe.
