Direct-Participation Theory of Individual Liability

Definition

A doctrine used to hold individuals personally liable for involvement in torts an entity commits. Required elements typically include showing the entity owed the claimant a duty of care and delegated that duty to an individual, and that the individual’s conduct breached that duty of care.
