Duty to Control

Definition

An obligation to control the conduct of others that arises from a special relationship between a defendant and a tortfeasor pursuant to which the defendant has an ability to control the tortfeasor’s conduct. The duty to control is an exception to the general rule that no one has a duty to control the conduct of others.
