Duty to Disclose Adverse Authority

Definition

A lawyer’s duty to disclose to a court any legal authority in the controlling jurisdiction that the lawyer knows to be directly adverse to his client’s position and that was not disclosed by the other side. Duty to disclose adverse authority is also referred to as the duty to disclose contrary authority.
