Existing Indian Family Doctrine

Definition

A common-law principle employed by some state courts that asserts that children with Indian ancestry who were never sufficiently affiliated with an Indian parent or tribe are not considered Indian children for purposes of the Indian Child Welfare Act and are thus excluded from application of the act.
