Definition

Rule of federal criminal procedure that (1) requires the transfer of a criminal proceeding to another district if the prejudice against the defendant is so great in the district in which the prosecution is pending that the defendant cannot obtain a fair and impartial trial there and (2) permits a proceeding to be transferred to another district for the convenience of the parties, any victim, and the witnesses, and in the interest of justice.
