Definition

A plaintiff’s filing of an illegitimate claim against a nondiverse defendant to join the defendant to a case and destroy diversity jurisdiction. If the joinder of a nondiverse defendant is fraudulent, that defendant will not be considered when a court determines whether diversity jurisdiction exists.
