Definition

An affirmative defense that acts to mitigate a murder charge to manslaughter if the defendant can prove that, as a result of provocation, he was overcome by emotion and did not have time to “cool off” before commission of a homicide. This defense is known as the sudden-passion defense in some jurisdictions.
