Lesion Beyond Moiety

Definition

In a civil-law jurisdiction, such as Louisiana, a sale of a corporeal immovable in which the buyer received less than one-half of the fair market value of the property. Under Louisiana state law, the seller in a lesion-beyond-moiety transfer may bring an action within a set time period against the buyer to recover the difference between what the buyer paid and the fair market value of the property.
