Definition

Material that was created by or for a party or a party’s agent in preparation for litigation. Although federal courts and courts in many jurisdictions typically treat material prepared for litigation as attorney work product for production purposes, New York treats material prepared for litigation as a separate category of materials that are conditionally immune from production.
