Definition

A power of attorney that is not effective immediately after execution but only comes into effect after the occurrence of a future event. If applied to a durable power of attorney, which survives even if the principal becomes disabled or incompetent, then the future event that triggers the power of attorney can be the occurrence of the principal’s disability or incompetence.
