Substantive Predicate

Definition

A factual situation or circumstance that is specified in a state law. If the law explicitly directs a state official to take a specific action whenever the substantive predicate is found to exist, the law creates a liberty interest that entitles a person affected by the law to due process protection under the Fourteenth Amendment to the United States Constitution.
