Definition

A juvenile court’s waiver of its jurisdiction over an alleged juvenile delinquent, transferring the juvenile’s case to an adult criminal court. There are judicial waivers in which a judge makes the waiver decision, automatic waivers as provided by statute, and prosecutorial or direct-file waivers in which a juvenile court and a criminal court have concurrent jurisdiction over a matter and a prosecutor decides to file charges against a juvenile in the adult criminal court.
