Facts
3637 Green Road Company, Ltd. (landlord) (plaintiff) sued its long-time tenant, Specialized Component Sales Company, Inc. (tenant) (defendant), for breaching their month-to-month lease agreement. The lease agreement prohibited any oral modification of its terms. The trial evidence proved that, years earlier, the tenant told the landlord that due to a downturn in the tenant’s business, the tenant would have to vacate the premises unless the landlord lowered the rent from the amount specified in the lease. The landlord orally agreed to a rent reduction and thereafter accepted the tenant’s checks for the lower amount. The trial court entered judgment for the landlord but awarded damages based on the lower rent. Seeking a higher award, the landlord appealed the award to the local court of appeals.
