Facts
The IDS Center was constructed in 1972. The building, including the fireproofing, was manufactured by Carey-Canada, Inc. (Carey-Canada) (defendant). The fireproofing was later discovered to contain asbestos. The 80 South Eighth Street Limited Partnership (80 South) owned the IDS Center by this time, and 80 South brought suit against Carey-Canada to cover the costs of maintenance, removal, and replacement of the fireproofing.
