Facts
A.W. (plaintiff) was a disabled student who was entitled to special-education services from the Jersey City Public School district (the district) (defendant) under the Individuals with Disabilities Education Act (IDEA). A.W. sued the district for violations of his IDEA rights in federal district court, including a claim brought under 42 U.S.C. § 1983. The district court held that the alleged IDEA violations were actionable under § 1983, denied the district’s motion for summary judgment, and held that there was sufficient evidence for a jury to find the district violated the IDEA. The district appealed.
