Facts
Abernathy (plaintiff) was a patient in a hospital run by the Sisters of St. Mary’s (hospital) (defendant). A hospital employee neglected to help Abernathy from his bed to the bathroom, causing him to fall and sustain injuries. Abernathy brought suit against the hospital, which moved for and obtained summary judgment on the grounds that it was a nonprofit charitable organization and thus immune from liability for its torts under the common law. Abernathy appealed.
