Abrahams v. Kidney
Massachusetts Supreme Judicial Court
104 Mass. 222 (1870)
- Written by Eric Miller, JD
Facts
A mother (plaintiff) brought an action against a man (defendant) who seduced her minor daughter, causing the daughter to become sick and unable to render services to the mother. The trial court excluded evidence that the seduction caused an injury to the daughter’s health, holding that pregnancy or sexual disease were the only bases on which the plaintiff’s claim could be sustained. A verdict was directed for the defendant. The plaintiff appealed. The Massachusetts Supreme Judicial Court granted certiorari.
