Facts
Robert Adair (plaintiff) was employed as a firefighter with the city of Muskogee (the city) (defendant). Adair was on paid leave for two years after he injured himself while working. In 2014 the city determined Adair’s injures had permanently affected his lifting ability. Adair received a workers’-compensation award and retired. However, Adair filed a disability-discrimination claim against the city in federal district court on the ground that the city had forced him into retirement after he was regarded as having an impairment. The district court granted the city summary judgment on the ground that Adair had failed to establish that he was regarded as having an impairment that substantially limited a major life activity. The matter was appealed.
